Signature Campaigns
One of the oldest forms of protest is also the most effective. Sooner or later, a Public Interest Litigations (PIL) will have to be filed against the 93rd Amendment Act. Public opinion strengthens the cause of a PIL. Download the format of a PIL from our website or e-mail us for a copy and print it out; request everyone signing it for their Full Name, Mobile No (Tel No), E-mail Address, Mailing Address (preferable). A. If implemented, sooner or later it will affect each one of us. Your friends, kids, relatives, employees applying to institutes of higher education or private colleges won’t be able to secure a seat even if they make it on the basis of merit.
Besides, we all want our hospitals to be equipped with the best doctors and nation to be built by the best engineers and our country to excel in every other industry. If students are trained on the basis of merit irrespective of their caste, this can be achieved.

Quota: Just how many OBCs are there?

Around 36 per cent of the country's population is defined as belonging to the Other Backward Classes according to the National Sample Survey's 1999-2000 round, and not 52 per cent as defined by the Mandal Commission, a number that most politicians still use while asking for reservation.
If you exclude Muslim OBCs, the proportion falls to 32 per cent according to the NSS, 1999-2000. Indeed, Yogendra Yadav, professor at the Delhi-based Centre for the Study of Developing Studies, who is in favour of reservation for OBCs, agrees that there is no empirical basis to the Mandal figure: "It is a mythical construct based on reducing the number of SC/ST, Muslims and others and then arriving at a number."
One of the reasons for the much higher Mandal number is that it defined OBCs in socio-economic terms, and so included, for instance, "castes/classes considered as socially backward by others". If, to cite another of the 11 criteria used, the percentage of married women below 17 years is a fourth above the state's average in rural areas (and 10 per cent in urban areas), the community is considered to be OBC.
Similarly, if castes/classes where the proportion of working women is 25 per cent higher than the state's average, the castes/classes are considered OBC - today's double-income families, if living in areas where women do not work, would then be considered OBCs using the Mandal definition.
In the NSS case, respondents were asked to indicate their caste, and this was then tallied with the list of castes that each state defines as OBC.
The NSS data is also corroborated by the National Family Health Statistics, a survey conducted in 1998 by the DHS, which has conducted 200 such surveys in 75 countries.
The NFHS data show that the proportion of non-Muslim OBCs is 29.8 per cent, a figure quite close to the NSS' 32.1 per cent. For SC/ST, while the NSS shows this is 28.3 per cent of the population, the NFHS estimates this at 27.9 per cent. The 2001 Census estimated the SC/ST population at 24.4 per cent, though the Census did not canvass any information on OBCs.
The share of the Muslims (including OBC Muslims) in all three data sets is quite similar, ranging from 11 to 13 per cent.
So far, the Supreme Court ceiling of 50 per cent on all reservations has been justified by arguing this covers only the non-creamy layer OBCs, since 22.5 per cent of all reservations are for SC/ST, leaving 27.5 per cent for the OBCs - that is, only around half the OBCs would be entitled to reservations.
If, you use the NSS/NFHS figures, a 50 per cent reservation ceiling will cover three fourths of all OBCs, and if Muslim OBCs are to be kept out of reservations, then 86 per cent of the remaining will get covered by reservations
What has been done is a standard Congress ploy picked up from the Britishers - which is to rake up populist issues without solving the core problems.
I would like to know if any of the Congress leaders or politicians would be interested in getting treated by a Dr who is not competent or s specialist - would they accept anyone one other than the best doctors treating patients like Mahajan - if not why this hypocrocy in there actions and thought process.
Laloo Yaday's daughetrs have studied in DPS - they have married to professionals who have come up thru merit. Many of our politicans and families with who are well off need to be denied any such benefits of reservations.
They need to ensure that steps are taken to see that all the people who need proper edcuation should be given education at government costs right from the primary stage.
For good education to happen - we need to support the teachers - by giving them market driven salary - so that we get good teachers to come into to the teaching professions.
Also stop subsidy to those that can afford it - and others should who are economically disadvantaged should be given complete education support - it is a price to pay - but I am sure when it is put across correctly - we will see that the benefit of reservations reach those that need it the most.
We need to get our politicans to start thinking in the 21st century - and not stick to something which is an outdated mode of uplifting the society. People need to be reasy to deal and work in a global competitive work place.
I noticed that you guys have put up a blog and stuff. Very nice job there. But your internet campaign lacks the punch. Your websites are full of text, text and more text. Impressions are not created by texts, friend - you gotta have pictures and videos. I saw the Sahara coverage with this very good anchor man on Tuesday May 16 at 9:00 night. These people had wonderfully depicted the entire struggle in moving and still pictures. Video of AN Roy blatantly lying about lathi charge had been put beside the video of the lathi charge showing AN Roy's lie in action - excellent way of depicting the truth. That beats the daylight out of pages and pages of text.
Here's what I suggest: Create a parallel website which consists of pictoral (for low bandwidth users) and video (high resolution for higher bandwidth users and low resolution for low bandwidth users) depiction of the entire drama that has unfolded in the past few days in the face of this unprecedented agitation. Rope in the Sahara media people if possible - that'll save you a lot of time in gathering and formatting the clips and pics. And remember - the files should be light weight so that the website is not bogged down due to bandwidth strangulation and poor bandwidth users are also able to view the website without problem. One more thing - keep the website independent of operating system or browser specificness - Windows and Internet Explorer are not the only software out there, y'know.
This is no ordinary agitation, my friend. This is the first time in the history of India that a movement is happening on this scale without the presence of central leadership or afiliation with any political party. So let no only Indians, but also the entire world know that it can be done - by the people for the people.

Will the 93rd Consitution Amendment Act survive the "basic structure" test?
There is sure to be a legal challenge to the Constitution 93rd Amendment Act on the grounds that it violates the "basic structure" of the Constitution.
Sudhir Krishnaswamy, writing in The Telegraph (January 31, 2006) puts forward two plausible arguments that the 93rd Amendment Act violates the "basic structure" of the Constitution:
The first argument against the amendment is that it destroys the basic feature of equality. The apex court has reiterated in the recent Mandal commission case (1994) when dealing with reservation in public employment that 'equality' is a basic feature of the Constitution. The Mandal commission ruling is not clear about the precise limits to state action that equality as a basic feature entails. As basic structure review operates at a permissive 'damage or destroy' standard, petitioners will have to show that the reservation amendment eviscerates the concept of equality in the Constitution.
As the Constitution adopts a concept of equality which permits special provisions for SC/ST and OBCs as valid derogations from a symmetrical equal treatment principle, this is a difficult argument to sustain. Such a low standard of scrutiny in basic structure review may seem incongruous, but considering that this is an exceptional power of judicial review where the court safeguards abstract constitutional values, the court's deference to the legislature's mode of setting out the equality principle is more appropriate. So basic structure review on equality grounds may fail to satisfy the 'damage or destroy' standard.
The second argument against the reservation amendment is that it fails to respect the division between the state sector and private sector. This argument would have to persuade the court to recognize a new basic feature: namely, the separation of state action from private action. It is clearly open to the court to do so as basic features are an open catalogue which may be expanded or modified through the common law method proceeding on a case-by-case basis. The right to associate freely [Article 19(1)(c)], read with the right to carry on any occupation, trade or business, or to practice any profession [Article 19(1)(g)] suggest that citizens enjoy the freedom to conduct their life as they choose to. This liberty is best illustrated by contrasting it with the constitutional obligations of the state to act within the fetters cast upon it by the fundamental rights of citizens (Article 13). These provisions read together suggest that the state/private distinction is a basic feature of our constitutional design. However, our Constitution does not maintain this distinction throughout. It clearly prohibits the practice of untouchability between private persons (Article 17) and imposes several fundamental duties on citizens, including the duty to abide by the Constitution (Article 51A (a)). The court has on previous occasions, as with sexual harassment, held that individual citizens may be required to respect the constitutional rights of citizens.
On balance, the court will assess whether the state/private distinction stands with democracy, equality and secularism as an inviolable constitutional principle or whether it is an important but malleable principle. In the last fifty years, the Supreme Court has interpreted the state action doctrine to include, and exclude, a wider range of public and private authorities against whom administrative law standards and rights guarantees are enforced. The most charitable understanding of this body of law would conclude that this area is in flux. In these circumstances, the court could refrain from anointing the state/private distinction as a basic feature of the Constitution.
and concludes that the 93rd Amendment Act will probably survive the "basic structure" test.
Affirmative action politics in India is obsessed with quotas. Political parties vie with each other to expand quotas to newer arenas for an ever-expanding category of beneficiaries. It may be shown that this policy neither advances the interests of its beneficiaries nor that of the nation. But bad policy is not always 'bad' legally. One would therefore not be wrong to conclude that the 104th Constitution Amendment Act 2005 should survive the Supreme Court's basic structure review and be declared constitutional.
We will have to wait to find out the judiciary's interpretation of whether the 93rd constitution amendment violates the "basic structure" of the constitution.
It is evident that the politicians (remember Joshi?)are hell bent on creating a huge back-door to wrest control of the elite institutions which are beyond the reach of their kin. This struggle is going to determine the fate of india's politics and it's top institutions, in fact the fate of modern India. Lesson must be drawn from Mandal-1. I donot wish to post a political comment here, but cannot ignore the psychophant ministers,puppet PM, and an insecure mother, are capable of wreaking heavoc to ensure continuation of the dynasty.

Plan of action for now:
1) File a PIL in the supreme court asking for a commission to be set up to review the existing reservation policy. The government will not set up a commission on it's own as it will be seen as a move against the reserved castes( it's vote bank ) and also because Lalu Prasad Yadav( a member of the OBC lobby) is a major partner of the government, without whose support the government could collapse.The Congress government, if it has to survive has to ensure that it does not displease Lalu Prasad Yadav.The only way out is to get the courts to do the job. At the same time, we have to keep up with the protests and morchas and awareness campaigns on our part. We have to take the help of the lawyer community on this step which, I believe, is also supporting our campaign.
2) Collect funds (if required) for those students who may be removed from the hostels due to the strike.We have to ensure that they are given proper accomodation during the period of the strike. After all, we are all fighting for a just cause and we need to support everyone who is in this movement. I am absolutely sure that not just the student community, but also the public at large will come out in support and help us in our fund collection drive. Also, this collection drive will generate more public awareness about the entire issue.
3) Take out morchas every Saturday/Sunday in all cities so that even working professionals/ housewifes/school-students can attend the protest march. Taking part in morchas on week-days is difficult for working professionals like me.After all, our intention is to make this a mass movement of the public at large.So we have to take out morchas on days when it is most convenient for the maximum number of people to attend.

I am very much game for the YFE agenda. But, it looks to me that we are ok with the govt plan of increase in seats.
I might have misread the signs but I seriously hope that this is not the case.
We should not relent. Quotas of any kinds should be totally done away with. Instead, aid of all sort should be provided to the financially backward. Economic criteria should be the only metric used and even then there must be no quota or reservation. Only then will equality prevail.
Provide them with all sorts of discounts, rebates , assistantiships, financial backing but do not let merit go for a toss. If we okay the seat increase then the fight is as good as lost.
On the flip side - no matter what happens - we are the losers.
If the govt sees the pressure increasing to an unbearable limit -they will relent and it will seem as if the UPA govt has heard our cries and that they are receptive to new world order. They will come into power again and the same issue will spring up.
On the other hand, if we give up then there is nothing to hope for in the future. The best thing to do is to emigrate.
Please do not let it become yet another lok paritran. Lets stay united and you will hvae all our support.
The Goverment's reponse to this agitations are very poor. As Major participants are Medical students whose basics start from learning that service is without discreetion to CASTE, CREED and SEX.
Secondly, Professionals participation is going to be much a effective.
It is also in news that Software gaint "Infosys" has started special training for backward classes and offering jobs. Which is great move on behalf of best employers. Probably it had to do so under the Political government Pressure. As in every interview they were being asked the opinion of weaker caste reservation in private sector. So encouragement to this agitation should also be gained from the industrialists and giant corporates which can definitely prove that the Caste cannot be the barriers for the individuals growth/development in society. most important is foundations of knowledge, and dreaming to achive heights of life. Atleast then the Politicains may feel shame on introducing plans and programmed for a mean cause of their votebanks

Starting from Mr. Arjun Singh, then all other politicians and their family members should be restricted to a Medical Treatment Law, which should be like this: All politicians should take treatment in Govt. Hospitals only, and not in the private 5 Star ones, and should only be treated by their beloved doctors who have qualified on the grounds of quota. I wonder how many of them will agree to this.
Who said that this country and the Economy is growing? Such a major contradiction this:
The quota system, when introduced, had a very clear intention of uplifting the weaker sections of the society, equlising them, and then eradicate the quotas, so that all the citizens are equal.
Now, after 59 years of independence, when your stock market overtakes the US's, Economical Growth rate is more than 8%, with an overall FEEL GOOD FACTOR, you need to increase the quota by almost 100%? Ridiculous!

Data is to be collected from IIT/IISc/IIM about the quality of students who join thru reservations and show the public how tough the competition is. the data is to be distributed among IT professionals and IT Giants in India who can aid the protest. I have been in IISc for the past 1 year and the competition is soo tough that u cant sleep for 4 hours a day!

First, I had experienced the jinx of reservations in past and that is why I am concerned about this.
Next, if the Government says that they are increasing the reservation for the matter of Social and Economic justice and equality, I would ask them to bring property act wherein none of the individual shall have property more than Rs. 5 crores. The property above this will go in Government's fund which they can use for betterment without getting into hassels of reservation. You can suggest this.
Next, is my advice to you all. Even if the PM is promising you something, do not go by their way. This is the right time you have. If you get back this time, you will repent for the same later, as you all know that the history speaks that none of the politicians kept their promises.
Also, I would suggest you to contact the Corporates, such as Tatas, Birlas etc. if they come forward to the cause it will be a huge boon for all. You contact them for their support.

All these reservations are politically motivated and is strengthening the roots of casteism and cast preferences in Indian society and specially in new generation. If Government is really interested in the welfare of some particular section of society, It should provide free education, free competition preparation schools and special cells to promote education and competition in this section. But rather than working in real and honest direction, It is just adopting quick shortcuts to befool real backward and scheduled class who is living in villages and is not even aware of any such reservations.
1.Are not these reservation continuously used by rich people and economically and socially respected families who happen to have these sc/bc certificates. Why they need reservation??
2. Reservation in medical? Are you crazy or what??. Do you want to play with human lives. If God forbid, you have a heart operation and admitted in PGI, and you are told that it will be done by a doctor who had not even 20% marks in medical education and he is crowned as a doctor using the stretcher of reservation, what will happen to you. WILL YOU ALLOW HIM TO OPEN YOUR HEART??????
3. Why one person show use reservation more than 1 time in his life. I know a lot of cases when a person used reservation for admission to a college , than reservation for job . Why? How many supports he need?
4. Why the son of a Engineer/Doctor who is earning 10 Lakhs a year need a reservation for his son just because he has a certificate??
I don’t think anybody is listening to striking students as PM,President of India are not responsible people but just ignorant people who are surrounded by foolish people.
Such irresponsible administration is the cause that India is still not a developed country.
Only New generation is a bit hope if ever something better can happen.

i am following the news everyday about the reservation and its very sad that even after 50 years of independence we are still not free from this taboo of society
the caste the religion etc are the system that we the mankind created for betterment and today the political group are using this for vote banks ,they are divinding the hearts of people by doing this
i strongly beleive that there should be not quotas for any proffessional courses like medi,engg etc it should be totally on merit ,quoats should be included only in pre graduate course just to help if govt feels so but when it comes for graduation level NO QUOTAS, because this seats will be holding future of country or lives of people and those undeserving candidates just because of quotas can be danger ahead for future of the country
so in long term ,is our country safe ?
during mandal commission of VP SINGH many lives were taken but govt didnt learn anything but not this time
the youth of the country shd come forward to fight against this and makes this country a better place to stay and live
i am sure bewcause of this many doctors who goes abroad for work or studies will be getting oppurtunity to serve their own nation if thsi quotas are removed

I was thinking, we are gonna have so massive support for our cause, we really should be thinking of channelising each and every individual's time and energy for the cause. Let us make a list of what we are good at. See I think I am good enough to come forward in debates on this issue. Similarly, some may be good at writing, some at reporting, some at recording, some at organising, some at interacting with people, some with organising for funds, some for creating stuff like T-shirts, pamphlets, badges, etc. We have to do a SWOT analysis guys. Our all efforts should be extremely organised and meticulous. This is not a child's play, and this is not a small fight as well. We are not only challenging the existing government, we are challenging the entire political system.
We will have to have the coverage on national television, local cables, radio stations, newspapers, online blogs, mails, sms campaigns, malls, corporate houses, other events, even rural places. We will have to plan and work around in a systematic manner. So I suggest, everyone put forth what they can do best. It can be anything. We can organise groups amongst those and group organisers and leaders in order to take care of specific activities. It would ensure no person's time and energy is gone waste.

Kudos to the doctors for forming YFE so quickly. Unless we do something for India, India will get hijacked and get disintegrated by caste and religion differences.
I have already started talking with people whom I know and found that not many are willing to speak openly. This must change for the benefit of future generations.
This is not whether we are Upward Castes or Backward Castes but whether merit means anything in India.
Why should Upward classes be discriminated against. This is reverse discrimination which should be fought against.

How do we make our India pride?
Every Individual is capable of thinking! Why do we restrict ourseleves to think beyond a certain view. Do we think all people from the so called Reserved category are not good. Do we think all people who live in India are having an urge to go to School and reach a good position in his/her life? So what is lacking here. The education in terms of encouragement. If your mind can conceive it and heart can believe it then you can surely achieve it. But where is the scope for conceive an idea of thinking beyond a certain view? Are our politicians give freedom to people to think or provide some basic need of a thought? How many crores of rupees are spent in terms of developing some back ward places? Are they really reached till the need ones? Where is the check. Neither the people from that area are bothered as it is coming with out effort not the government check whether they received? So what is happening here? A kind of negligence. Who is to be blamed for this kind of attitude?
We have seen many people who are rich and capable of running big businesses talk about reservations. Do they really help the people or increase their business by encouraging reservations. How many people who enjoyed reservations and reached a certain position where his/her next generation doesn't bother about any social support are coming forward to give up reservations and lend a helping hand to poor? Now in India there are uncountable NGOs helping poor with out looking for Government's role in them. How many of the reserved category is taking this kind of movement among at least in backward areas.
How do we want to see our Country in 2020. An energetic foward country with wisdom of voice and shapen brains or wisdom of reservations with thought less leaders.
What should we propose to the government?
To check the funds how they are getting utilised to raise the self esteem of people in the back ward areas and help their life styles that will make people capable of taking up any education with out reservations. Look at Abraham lincoln who grew to a President's position with lots of efforts in his life. We need to raise individuals' self esteem not Reservations.
